1. Agreement to Terms

Welcome to TaskStart. These Terms of Service ("Terms") govern your access to and use of the TaskStart task management application, website, and related services (collectively, the "Service") provided by Anu Jain as a personal/individual project ("TaskStart," "we," "us," or "our").

Important Notice: TaskStart is operated as a personal project by an individual developer, not as a registered business entity or corporation. The Service is provided on an individual basis.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

Legal Notice: These Terms contain a mandatory arbitration provision and class action waiver (Section 15), which may affect your legal rights.

2. Beta Service Disclaimer

IMPORTANT: TaskStart is currently in BETA testing as a personal development project. This means:

  • The Service may contain bugs, errors, or incomplete features
  • Features may change, be removed, or added without notice
  • Data loss or service interruptions may occur
  • No warranties are provided regarding uptime or reliability
  • We recommend backing up important data outside of TaskStart
  • As a personal project, support and updates are provided on a best-effort basis
  • The Service may be discontinued at any time with or without notice

By using the beta Service, you acknowledge these risks and the individual/personal nature of this project. You agree to provide feedback to help improve TaskStart.

3. Eligibility

You must be at least 13 years old (or 16 years old if you are in the European Economic Area) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

To use certain features of the Service, you must create an account using Google OAuth authentication. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

3.2 Account Responsibility

You are solely responsible for all content and activity in your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Acceptable Use

4.1 Permitted Use

The Service is provided for your personal or internal business use to manage tasks and improve productivity.

4.2 Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload or transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal, harmful, or abusive purpose
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Scrape, crawl, or use automated tools to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or harvest user information without consent
  • Use the Service to send spam or unsolicited communications
  • Resell or commercially exploit the Service without authorization

5. AI Features and Limitations

Important AI Disclaimer: TaskStart uses artificial intelligence (Google Gemini API) to provide task suggestions and assistance. AI-generated content may be inaccurate, incomplete, or inappropriate.

5.1 AI Functionality

Our AI features:

  • Provide task clarification and organization suggestions
  • Process your task data through Google Gemini API
  • Generate suggestions that you may accept, modify, or reject
  • Are provided as a convenience and productivity aid only

5.2 AI Limitations and User Responsibility

You acknowledge and agree that:

  • AI suggestions are not guaranteed to be accurate, complete, or suitable for your needs
  • You are solely responsible for reviewing and verifying all AI-generated content
  • We are not liable for decisions you make based on AI suggestions
  • AI features may occasionally produce unexpected or irrelevant results
  • You should not rely solely on AI for critical decisions

5.3 Data Processing for AI

When you use AI features, your task data is sent to Google's servers for processing. You consent to this data processing when you use AI features. See our Privacy Policy for more details.

6. Intellectual Property Rights

6.1 Our Rights

The Service and its original content, features, and functionality are owned by TaskStart and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Rights

You retain all rights to the content you create and upload to the Service (your tasks, notes, and data). By using the Service, you grant us a limited license to:

  • Store and process your content to provide the Service
  • Make backups for service reliability
  • Display your content back to you through the Service interface

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

8. Health and Medical Disclaimer

Not Medical or Mental Health Advice: TaskStart is a productivity tool, not a medical or mental health service.

While we may reference concepts like task paralysis, overwhelm, anxiety, or ADHD:

  • We are NOT providing medical, psychological, or therapeutic advice
  • The Service is NOT a substitute for professional mental health care
  • We do NOT diagnose, treat, or cure any medical or mental health conditions
  • If you are experiencing mental health difficulties, please consult a qualified healthcare professional
  • In case of emergency, contact emergency services immediately

The Service is designed to help organize tasks and may be helpful for productivity, but it should not replace professional medical advice, diagnosis, or treatment.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

  • You may request data export before termination

Important: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or availability of the Service
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding AI-generated content or suggestions
  • Any warranties arising from course of dealing or usage of trade

We do not warrant that:

  • The Service will meet your requirements or expectations
  • The Service will be available at any particular time or location
  • Defects or errors will be corrected
  • The Service is free of viruses or harmful components
  • Data stored in the Service will not be lost or corrupted

13. Limitation of Liability

Liability Limit: Our liability is strictly limited as described below. As this is a personal project (not a business entity), no commercial warranties apply.

IMPORTANT: As this is a personal project operated by an individual (not a business entity), the following limitations apply:

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

13.1 No Indirect Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or data corruption
  • Cost of substitute services
  • Loss of goodwill or reputation
  • Personal injury or emotional distress
  • Any other indirect or consequential losses

13.2 Cap on Direct Damages

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • $100 USD, OR
  • The amount you paid us in the 12 months before the claim arose

13.3 Applicability

These limitations apply:

  • Regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise)
  • Even if we have been advised of the possibility of such damages
  • Even if a remedy fails of its essential purpose

13.4 Exceptions

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless TaskStart, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content or data
  • Your violation of applicable laws or regulations

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending a written notice to support@taskstart.app. We will attempt to resolve the dispute within 60 days.

15.2 Binding Arbitration

If informal resolution fails, you agree that any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except:

  • You may assert claims in small claims court if they qualify
  • We may seek injunctive relief in court for intellectual property infringement

15.3 Class Action Waiver

Important: YOU AND TaskStart AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15.4 Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Florida.

16. International Users

The Service is operated from the United States (hosted on AWS in US East region). If you access the Service from outside the United States, you are responsible for compliance with local laws.

We make no representation that the Service is appropriate or available for use in all locations. We provide service globally but are based in Florida, United States.

17. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top
  • Notify you via email or through the Service
  • Provide at least 30 days' notice for material changes

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

18. General Provisions

18.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and TaskStart regarding the Service.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

18.6 Survival

Sections that by their nature should survive termination will survive, including: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.
